Welcome to NissMatch. These Terms of Service ("Terms") govern your access to and use of the NissMatch platform, including our website at nissmatch.company, mobile applications, and all related services (collectively, the "Service"). By creating an account or using NissMatch, you agree to be bound by these Terms.

NissMatch is a premium matrimonial platform designed for individuals seeking serious, marriage-minded relationships. The Service is operated by NissMatch LLC, a company registered in the State of Delaware, United States.

1. Eligibility

To use NissMatch, you must:

• Be at least 18 years of age. By registering, you confirm that you are 18 or older.
• Be legally eligible to marry under the laws of your country of residence. You must not be currently married, unless legally separated and pursuing divorce proceedings.
• Have the genuine intent to seek a life partner for marriage. NissMatch is not a platform for casual dating, short-term relationships, or non-committal connections.
• Be able to form a legally binding contract and not be prohibited from using the Service under applicable law.
• Complete identity verification through our partner Veriff to maintain the safety and authenticity of our community.

We reserve the right to refuse service, terminate accounts, or restrict access to anyone who does not meet these eligibility requirements.

2. Account Registration and Security

• You must provide accurate, current, and complete information during registration and keep your profile information up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account or any other security breach.
• You may not transfer your account to another person or create an account on behalf of someone else without their explicit permission.
• You may maintain only one active account at any time. Creating multiple accounts to circumvent restrictions, bans, or subscription limits is prohibited.

3. Identity Verification

NissMatch requires identity verification to create a safe and trustworthy community. By using the Service, you agree to:

• Submit a valid, government-issued photo identification document for verification.
• Provide a real-time selfie photograph for biometric matching against your ID document.
• Consent to the processing of your verification data by our partner, Veriff, in accordance with their privacy policy and our Privacy Policy.

Verification does not guarantee the character, intentions, or suitability of any member. While we take reasonable measures to verify identities, you are responsible for exercising your own judgment when interacting with other members.

4. Acceptable Use and Prohibited Conduct

You agree to use NissMatch respectfully and in compliance with all applicable laws. The following conduct is strictly prohibited:

4.1 Fake Profiles and Misrepresentation

• Creating a profile using someone else's identity, photographs, or personal information.
• Providing false or misleading information about yourself, including age, marital status, education, or occupation.
• Using outdated, heavily edited, or deceptive photographs that do not accurately represent your current appearance.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.

4.2 Harassment and Harmful Behavior

• Harassing, threatening, stalking, or intimidating any member.
• Sending unsolicited sexual content or messages of a sexual nature.
• Engaging in hate speech, discrimination, or derogatory remarks based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Pressuring, coercing, or manipulating other members in any way.
• Continuing to contact a member who has asked you to stop or has blocked you.

4.3 Cultural Sensitivity

NissMatch serves a diverse community with members from various cultural backgrounds. You agree to:

• Treat all members with dignity and respect, regardless of their cultural practices or level of religious observance.
• Refrain from making disparaging comments about any culture, tradition, or community.
• Respect boundaries related to cultural or religious practices in your interactions.
• Not use the platform to promote extremist views or ideologies of any kind.

4.4 Commercial and Fraudulent Activity

• Using the platform for commercial purposes, advertising, or solicitation.
• Engaging in financial fraud, scams, or requesting money from other members.
• Distributing spam, malware, or phishing content.
• Scraping, data mining, or using automated systems to access the Service.
• Attempting to reverse-engineer, decompile, or access the source code of the Service.

5. Content Guidelines

You retain ownership of the content you post on NissMatch. By posting content, you grant NissMatch a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and promoting the Service.

You agree not to post content that:

• Is sexually explicit, pornographic, or obscene.
• Depicts or promotes violence, self-harm, or illegal activities.
• Infringes on the intellectual property rights of others.
• Contains personal contact information (phone numbers, addresses, social media handles) in profile text or photos. Contact sharing is permitted only through our messaging system.
• Contains photographs of minors without their parent or legal guardian present in the photo.

We reserve the right to remove any content that violates these guidelines or that we deem inappropriate for the platform, at our sole discretion.

6. Subscriptions and Payments

6.1 Free and Premium Tiers

NissMatch offers two paid subscription plans: NissMatch Standard ($9.99/month) and NissMatch Premium ($24.99/month), with enhanced features including priority matching, unlimited messaging, and advanced compatibility insights. There is no free tier.

6.2 Billing

• Premium subscriptions are billed in advance on a recurring basis (monthly, quarterly, or annually) through Stripe.
• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• Prices are listed in your local currency where available and include applicable taxes.
• We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

6.3 Cancellation and Refunds

• You may cancel your premium subscription at any time through your account settings or by contacting support.
• Upon cancellation, you retain access to premium features until the end of your current billing period.
• Refunds are provided within 14 days of initial purchase if you have not used premium features (in accordance with EU consumer protection laws). After 14 days, or if premium features have been used, refunds are at our discretion.
• If your account is terminated for violating these Terms, you are not entitled to a refund.

7. Matching Service

NissMatch uses advanced algorithms to suggest compatible matches based on your profile, questionnaire responses, and preferences. You acknowledge and agree that:

• Match suggestions are recommendations, not guarantees of compatibility or successful outcomes.
• The quality and quantity of matches depend on the availability of compatible members in your area and preference criteria.
• NissMatch does not guarantee that you will receive a specific number of matches, find a partner, or achieve any particular outcome.
• Match expiration policies are in place to encourage timely engagement. Expired matches may not be recovered.
• The matching algorithm is continuously refined and may change over time.

8. Safety and Reporting

We are committed to maintaining a safe environment. If you encounter any behavior that violates these Terms or makes you feel unsafe:

• Report the user through the in-app reporting feature or by emailing safety@nissmatch.company.
• Block the user to prevent further contact.
• If you are in immediate danger, contact your local emergency services.

We investigate all reports and may take action including warnings, temporary suspension, or permanent account termination. For more information, see our Safety Guidelines.

9. Intellectual Property

The NissMatch name, logo, branding, matching algorithms, website design, and all associated content are the intellectual property of NissMatch and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute any of our intellectual property without prior written consent.

10. Disclaimers and Limitation of Liability

10.1 Service Provided "As Is"

NissMatch is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, availability, or fitness for a particular purpose of the Service.

10.2 No Guarantee of Outcomes

We do not guarantee that you will find a partner, that matches will be compatible, or that any interaction on the platform will result in marriage or any other outcome. You use the Service at your own risk.

10.3 Limitation of Liability

To the maximum extent permitted by law, NissMatch, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, the conduct of other members, or any other matter related to the Service. Our total liability for any claims arising from or related to the Service is limited to the amount you paid to NissMatch in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless NissMatch, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person.

12. Termination

• You may delete your account at any time through account settings. Account deletion is processed within 30 days.
• We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited conduct, or if we reasonably believe your account poses a risk to other members or the platform.
• Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitations of liability) will survive.

13. Dispute Resolution

If you have a dispute with NissMatch, we encourage you to contact us first at support@nissmatch.company to seek an informal resolution.

These Terms are governed by the laws of the State of Delaware, United States. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States, without regard to conflict of law principles. EU residents retain the right to bring claims in their country of residence and may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the platform. Your continued use of NissMatch after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and delete your account.
